General terms and conditions of the HempLight online store! The store is compiled in accordance with the Consumer Protection Act, the recommendations of the Chamber of Commerce and Industry and international e-commerce codes.

Definition

The provider is the HempLight online store, Libona d.o.o.so.p, Radgonska c.2, 2235 Sv.Trojica, the owner of the HempLight online store. The company Libona d.o.o.so.p. is a member of the Chamber of Commerce and Industry and does not require a special permit to carry out its activities.

A user is a person who uses our system, i.e. a buyer in the online store

The online store is an information system intended for the presentation and sale of products to the user

Login

When registering in the online store, the visitor obtains a username that is the same as his email address and a password that he chooses. The username and password of the user unambiguously determine and associate with the filled-in data. After registration, the visitor becomes a user and acquires the right to purchase. The General Terms and Conditions of Business address the operation of the HempLight online store (www.hemplight.net), the rights of the user and the business relationship between the provider and the buyer.

The provider undertakes to always provide the buyer with the following information:

company identity (name and registered office, registration number)

contact addresses that enable quick and efficient communication (e-mail)

essential characteristics of the goods or services (including after-sales services and guarantees)

availability of the products (each product or service offered on the website should be available within a reasonable period of time)

terms of delivery of the product or performance of the service (method, place and time of delivery)

all prices must be clearly and unambiguously specified, it must be clear whether they already include taxes and transport costs

method of payment and delivery

temporal validity of the offer

period within which it is still possible to withdraw from the contract; in addition, whether and how much it costs the buyer to return the product

the procedure for complaints must be explained, including all information about the contact person or customer relations department

Purchase process

Once you have selected the product you would like to purchase, add it to your shopping cart by clicking the “add to cart” button. You can find the cart symbol in the upper right. If you scroll or click on it, you will see the contents of the cart with the products you have collected (image, description and price of the product). In the cart, you can change the quantity of the product or products or remove individual products from the cart before completing the purchase.

Do this as follows: if you want to increase the number of selected products, click on the “+” sign, if you want to decrease the number of selected products, click on the “-” sign, if you want to remove an individual product from the cart, click on the “x” sign.

You can then continue shopping and adding products, or go to the checkout.

Once you have selected all the products and checked that you have the right products in your cart, continue by clicking on the checkout. In this step, you enter your personal information if you are making a purchase as a guest. For customers who have previously registered with our system, the data will be filled in automatically when they log in again with their password.

If you wish, you can also choose delivery to a different address after entering your data. You can do this by clicking on the text “DELIVERY TO ANOTHER ADDRESS?” Then enter the name and address where you want the ordered item to be delivered.

In the next step, click on the payment method and before completing the order, check all the entered data (personal data, delivery address, selected products and quantities of selected products, payment method) if they are correct.

Before completing the order (BUY NOW button), confirm the terms and conditions and privacy policy by clicking on the button after you have read:

  • I have read and agree to the website’s terms and conditions
  • I have read and fully agree to the privacy policy

To complete the purchase, press the BUY NOW button. The online store automatically “generates” the order and sends an email with the order details (products, prices, quantities, user data, etc.) to the email address you entered. The order is confirmed and the products will be shipped as soon as possible. If the delivery time is more than 2 business days, the provider will notify the buyer.

By completing the order, you assume the obligation to receive the ordered item and receive a copy of the order to the email address you entered. Submitting your order obliges you to pay for it.

ORDER CANCELLATION

Order cancellation is possible up to 1 hour after placing the order, or until 12:00 (applies to orders placed just before 12:00). After this time, the packages are handed over to the delivery service and in most cases the next business day to the addressee.

Payment

The provider issues an invoice on a durable medium, with itemized costs. The user pays with payment cards, via PayPal or by pro forma invoice to a bank account (applies to Slovenia).

The invoice itemizes the price and costs related to the purchase.

The buyer is obliged to check the correctness of the data before placing the order.

Delivery time

For products in stock, the delivery of goods is 1-2 business days. In the event of a longer delivery time, we will inform you about the delivery time by email or by phone.

Delivery

The provider must deliver the goods or services within the promised time. Upon delivery, the provider must provide the user with additional information regarding the right of withdrawal, especially the conditions and method of exercising the right itself. It must provide all necessary information regarding the address where the user can contact in the event of a complaint and information regarding warranties and service or other services after the conclusion of the contract.

Transportation is always paid by the customer of the products. Ordered items are shipped within 1-2 days of the order, or from the payment of the pro forma invoice, the ordered item usually arrives at the customer the next business day, it rarely takes longer. When we process the order and ship it, we will notify you of this via the e-mail you provided in the contact. Shipments are trackable, so you can contact us and write to us at info@hemplight.net if you have not received the package, or if you are waiting for it for a long time. We will check where the shipment is.

Shipping costs for Slovenia are:

  • 3.50 EUR including VAT, if payment is made by invoice, card or via PayPal.

All prices for products are in EUR and include VAT (value added tax)

For purchases over 50 EUR including VAT, shipping is FREE. For purchases up to 50 EUR, we will charge you a shipping fee and it is shown as a separate item on the invoice.

Additional delivery and shipping costs are not charged.

We use Pošta Slovenije for delivery of orders.

Delivery via Pošta Slovenija:

Ordered products will be delivered to the address you provided as the delivery address. Deliveries are mostly made in the morning. If you are unable to collect the shipment at the time of delivery, you can collect it later at the nearest Slovenian post office (15 days).

Before completing the order, you are familiar with the following sentence: “By placing the order, the buyer assumes the obligation to pay”. By completing the order, you agree to this sentence and receive a copy of the order to the provided email. Placing your order thus obliges you to pay for it.

*PAYMENT BY PROVISIONAL INVOICE FOR SLOVENIA

For the amount of the commission when paying by provisional invoice, please ask the bank through which you are making the payment. When paying by provisional invoice, the commission for paying the UPN form according to the Pošta Slovenija price list is not paid. This means that you pay the purchase price + shipping costs of 3.50 EUR for the territory of Slovenia.

The order according to the pro forma invoice is valid for only 3 working days. Therefore, WE ONLY KEEP ITEMS WITH THE PRO FORMA INVOICE FOR 3 WORKING DAYS. After three days, it is considered that you withdraw from the purchase, your order is canceled and the items are returned for sale.

*PAYMENT VIA PAYPAL SYSTEM

Paypal is an easy and, above all, secure way to pay for orders online. Your credit card number is not known to us as the seller. When paying with Paypal, you can use Visa, Mastercard, AmericanExpress, etc. To start using the Paypal system, you must create a user account, which is free and provides users with anonymous, secure and fast transactions.

Delivery to Croatia

Shipping costs are up to 5kg – €5.90 including VAT. Payment is possible via pre-invoice, PayPal or card. Shipping is always paid by the customer. Ordered items are shipped within 1-2 days of the payment being visible on our account, the order usually arrives to the customer in 2-3 working days, and to the islands in 4-5 working days. When we process the order and ship it, we will notify you via the email you provided in the contact. Shipments are trackable, so you can contact us and write to us at info@hemplight.net if you have not received the package, or if you are waiting for it for a long time. We will check where the shipment is located.

Delivery to other EU countries

Shipping costs are up to 5 kg. Payment is possible via pre-invoice, PayPal or card. Shipping is always paid by the customer of the products. We ship ordered items within 1-2 days of the transfer being visible on our account. When we process the order and ship it, we will notify you via the email you provided in the contact. Delivery to other countries outside the EU

Customers from non-EU countries please contact us at info@hemplight.net for the order and shipping cost. We will be happy to prepare an offer for you.

PROMOTION CODES

Promotion codes or Discount codes are date-specific and only apply to the listed products at regular prices and when the customer enters the order directly. The discount is calculated automatically. Subsequent entry of the code into an already placed order, where the code has not been entered by the customer, is not possible, nor is the code valid for orders already placed in the past. Discount codes are mutually exclusive, which means that you can only use one discount code in an order at a time.

Discount codes do not apply to products that are subject to exchange for an already placed order.

Right to withdraw from the contract, return/exchange of goods

WITHDRAWAL FROM THE CONTRACT:

INFORMATION RELATED TO THE EXERCISE OF THE CONSUMER’S RIGHT TO WITHDRAW FROM A DISTANCE CONTRACT Right to withdraw from the contract The consumer has the right to withdraw from a distance contract without giving reasons. The withdrawal period expires within 14 days from the day on which the consumer acquires physical possession of the goods or a third party other than the carrier and designated by the consumer acquires them for this purpose. To exercise the right of withdrawal, the consumer must inform the company by an unequivocal statement at the address Libona d.o.o.,so.p. tel. no. 041 818 529, e-mail: info@hemplight.net, of his decision to withdraw from this contract (e.g. by letter sent by post or e-mail). For this purpose, the consumer may optionally use the model withdrawal form (below in this document). In order for the withdrawal period to be observed, it is sufficient that the notification regarding the exercise of the consumer’s right to withdraw from the contract is sent before the expiry of the withdrawal period from the contract. Effects of withdrawal from the contract: If the consumer withdraws from the contract, the company shall reimburse all payments received from the consumer without undue delay and in any event not later than 14 days from the date on which the consumer receives the notice of withdrawal from the contract, provided that by that time the consumer returns the goods to the company (undamaged and in the same quantity) or provides the company with proof that the goods have been sent back, whichever is the earlier. The company shall make such reimbursement using the same means of payment as was used for the original transaction, unless expressly agreed otherwise; in no event shall the consumer bear any costs as a result of such reimbursement. The consumer shall return or deliver the goods in the condition in which they were delivered to him (undamaged and in unchanged quantity) in person or by post to the address Libona d.o.o.so.p., Radgonska c.2, 2235 Sv.Trojica, without undue delay and in any event no later than 14 days from the day on which the consumer informed the company of his withdrawal from the contract. The deadline shall be observed if the consumer sends the goods back before the expiry of the 14-day period. The direct costs of returning the goods (postage costs or personal return costs) shall be borne by the consumer. The consumer shall only be liable for any diminished value of the goods due to handling of the goods that is not strictly necessary to determine their nature, properties and functioning.

Returns are only possible under the conditions stated under “Right to withdraw from the contract”.

When exchanging goods, the prices for purchased products that are on your invoice and that you paid for them are of course taken into account. For newly selected products, the prices in the online store at the time we receive your purchased products for exchange are taken into account. When exchanging products, coupons or discount codes cannot be redeemed, as they are intended for use with a NEW PURCHASE.

COMPLAINT

In cases where you have received a shipment that does not include all documents, the information on the invoice is incorrect, and in other similar cases, please contact info@hemplight.net with a description of the defect. We will provide you with the appropriate explanation, instructions, or deliver the missing material as soon as possible.

We advise that when you receive the goods, inspect them and if you find a defect in the goods that is not in accordance with what is stated in the online store, inform us via the RETURN OF GOODS form, where we will agree on the further procedure. The purchased item is returned together with the undamaged packaging. The packaging is part of the sales item. If part of the packaging is torn or damaged, the product is considered to have been used. The costs of returning the goods are covered by the buyer.

MATERIAL DEFECT

A defect is material:

if the product does not have the properties necessary for its normal use or for sale;

if the product does not have the properties necessary for the specific use for which the buyer is purchasing it, but which was known to the seller or should have been known to him;

if the product does not have the properties and characteristics that were explicitly or tacitly agreed or prescribed;

The buyer may exercise his rights under a material defect if he notifies the provider of the defect within two months of the defect being discovered. The provider is not liable for material defects after 2 years have passed.

A material defect must be reported in writing to info@hemplight.net . The deadline for eliminating a material defect is 8 days from the written notification of the buyer’s defect.

In the event that a material defect is identified, the buyer may request a new product, a refund or a refund of part of the purchase price in proportion to the defect.

The right to claim a material defect is more precisely defined by the Consumer Protection Act.

GUARANTEE

The buyer can claim a defect at any time during the warranty period. The consumer can claim the warranty for products for which there is a mandatory warranty (the list of these products is determined by the Rules on Goods for Which a Warranty is Issued for Faultless Operation) and for those for which a voluntary warranty has been given. During the warranty period, the consumer can request the guarantor to eliminate the defect free of charge. If the defect cannot be eliminated or the company does not eliminate it within a total period of 45 days, the consumer can request a replacement for a new product free of charge. What is the procedure for claiming the warranty?

Within the warranty period and under the warranty conditions, the buyer must request the guarantor to eliminate the defects in a written application, submitting both the product and the warranty certificate and a copy of the invoice. The buyer does not incur any costs for eliminating the defects or replacing the product. If the seller determines that the defect in the product was caused by the buyer’s improper conduct, which results in the warranty claim being unjustified, the product will be returned to the buyer with written notice at their expense.

DAMAGED SHIPMENTS, NON-ACCEPTANCE OF SHIPMENTS

TREATMENT OF DAMAGED SHIPMENTS

If upon receipt of the shipment you notice that the shipment is physically damaged, missing contents or shows signs of being opened, please notify us immediately at 041 818 529 or at info@hemplight.net, where you will receive all further information. We will initiate the complaint procedure with Pošta Slovenije. Leave the package in the same condition as you received it (without adding or removing anything), and keep the original packaging! When reporting damage, we will also need photos of the package, (inner) packaging, damaged item, postal label and a description of the damage.

The claim is processed by a commission at the Slovenian Post Office and, based on their response or approval, the buyer will be refunded the purchase price or a new item will be ordered. We will do our best to resolve the complaint as soon as possible.

NON-COLLECTION OF THE ORDER

When your order is processed and delivered to the post office, you will receive a message from us to the e-mail address you entered when placing the order, so that you can expect the package in the following days. If the postman cannot deliver the package to you in person, he will leave a Notice of Delivery in your mailbox. The time for collecting the ordered item at the post office is 15 days. The package will wait for you for that long and if you do not collect it, it will be returned to our address. If for any reason you do not have a Notice from the postman, please contact us at info@hemplight.net and we will provide you with the information you need to collect the package without this slip.

Consequences of not picking up the package:

A returned package that the customer does not pick up causes additional costs for us, which we must pay to the delivery person. In the future, we will only ship new orders to such customers after prior payment via proforma invoice, PayPal or credit card. Unfortunately, payment upon receipt is no longer possible.

Any intentional damage caused by ordering and not picking up the ordered item (false orders) can be traced and if suspected, we will hand over the case and IP address to the responsible departments for further processing as abuse.

Validity of the offer

When purchasing, the prices at the time of order confirmation apply. All prices are exclusive of VAT according to point 1 of Article 94 of the VAT Act.

Security

The provider uses appropriate technological and organizational means to protect the transmission and storage of personal data, orders and payments.

Communication

The provider may contact the user via means of distance communication only if the user does not expressly object to this.

Archiving contracts

The contract concluded between the provider and the user is permanently stored at Libona d.o.o.so.p., Radgonska c.2, 2235 Sv. Trojica. The buyer can obtain a copy by requesting it at info@hemplight.net.

Advertising emails must contain the following components:

  • must be clearly and unambiguously marked as advertising messages
  • the sender must be clearly visible
  • various campaigns, promotions and other marketing techniques must be marked as such. The conditions for participating in them must also be clearly defined.
  • the user’s wish not to receive advertising messages must be respected

Complaints

The provider complies with applicable consumer protection legislation. A complaint can be submitted via the e-mail address info@hemplight.net. The provider will confirm to you within five working days via your e-mail address that it has received the complaint and will inform you of the estimated time for its consideration. The Provider is aware that the essential characteristic of a consumer dispute, at least as far as judicial resolution is concerned, is its disproportionality between the economic value of the claim and the costs incurred in resolving the dispute itself. This is also the main obstacle to the consumer not initiating a dispute in court. Therefore, the Provider makes every effort to resolve any disputes amicably.

The hemplight.net online store does not recognize any provider responsible for out-of-court dispute resolution (ODR) with which the consumer could resolve disputes via the European Commission’s online dispute resolution platform
